These Terms of Use (“Terms”) govern your access to and use of Helpmap.us, including its website, maps, reporting interfaces, messaging integrations, data services, and related features (collectively, the “Services”).

The Services are developed and maintained by Helpmap Agency (“Helpmap,” “we,” “us,” or “our”), a nonprofit organization dedicated to community-led climate adaptation and open-source public infrastructure.

Please read these Terms carefully.

BY ACCESSING OR USING THE SERVICES, OR BY SUBMITTING A REPORT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT SUBMIT A REPORT OR OTHERWISE USE THE SERVICES.

1. Purpose of the Services


Helpmap provides community-led climate readiness, emergency mapping, information sharing, and situational-awareness technology.

The Services may allow users to:

  • view community-generated reports;

  • view information supplied by public agencies and third parties;

  • submit location-based reports concerning hazards, emergencies, infrastructure conditions, or other relevant events;

  • submit descriptions, photographs, and related information;

  • share public reports;

  • compare information from multiple sources; and

  • access other tools intended to support community awareness, preparedness, response, and recovery.

Helpmap is designed to facilitate information sharing. It is not designed to replace emergency services, official warning systems, professional advice, or decisions made by competent public authorities.

2. Helpmap Is Not an Emergency Service


HELPMAP IS NOT A 911 SERVICE, EMERGENCY DISPATCH SERVICE, FIRST-RESPONDER SERVICE, GOVERNMENT WARNING SYSTEM, OR SUBSTITUTE FOR ANY OF THEM.

If you or another person is in immediate danger, call 911 or the appropriate emergency service. Submitting information to Helpmap does not constitute contacting emergency services.

Helpmap does not promise or guarantee that:

  • an emergency responder will receive a report;

  • a government agency will receive a report;

  • any person or organization will monitor a report;

  • anyone will respond to or act upon a report;

  • a report will be transmitted immediately;

  • a report will appear on the map;

  • a report will remain on the map; or

  • any action will be taken as a result of information submitted through the Services.

You remain responsible for contacting emergency services or competent authorities when circumstances require them.

3. No Duty to Monitor, Verify, Warn, Rescue, or Act


Helpmap provides information infrastructure. Unless expressly required by applicable law, Helpmap does not undertake and does not assume any duty to:

  • continuously monitor the Services;

  • review every report;

  • independently investigate any report;

  • verify whether a report is true;

  • confirm the location of an incident;

  • confirm that a hazard still exists;

  • identify inaccurate or misleading information;

  • correct information within any particular period;

  • provide warnings;

  • identify persons in danger;

  • contact emergency responders;

  • dispatch assistance;

  • prevent injury, loss, or damage;

  • advise users whether to evacuate, shelter, travel, remain in place, or undertake any other action; or

  • ensure that government agencies, responders, community organizations, or other users receive or act upon information.

No submission, publication, moderation decision, communication, omission, or other activity by Helpmap creates a special relationship, fiduciary relationship, professional relationship, rescue obligation, emergency-response obligation, or other duty beyond any duty that applicable law expressly imposes and does not permit the parties to limit.

4. Reasonable Efforts Standard; No Guarantee


Helpmap may use reasonable efforts to operate, maintain, moderate, improve, secure, and restore the Services and to address identified technical, safety, privacy, or information-quality issues.

Any such efforts are provided on a reasonable efforts, non-guaranteed basis and are subject to available personnel, funding, infrastructure, connectivity, technical capacity, third-party services, emergency conditions, and other circumstances.

Nothing in these Terms creates:

  • a service-level agreement;

  • an uptime guarantee;

  • a response-time guarantee;

  • a verification guarantee;

  • a moderation guarantee;

  • a cybersecurity guarantee;

  • a data-retention guarantee;

  • a duty to achieve a particular result; or

  • a contractual obligation to exercise “best efforts” or any heightened standard beyond reasonable efforts required by applicable law.

Helpmap may prioritize activities in its discretion, including during emergencies when demand, outages, infrastructure failures, or rapidly changing conditions may affect the Services.

5. Information May Be Incomplete, Delayed, or Wrong


Information displayed through the Services may originate from community members, public agencies, government data feeds, mapping providers, third-party platforms, automated systems, or other external sources.

Such information may be:

  • inaccurate;

  • incomplete;

  • outdated;

  • delayed;

  • duplicated;

  • incorrectly categorized;

  • incorrectly located;

  • mistranslated;

  • unavailable;

  • based on an unverified report;

  • superseded by later events; or

  • inconsistent with information from another source.

The presence of information on Helpmap does not guarantee that Helpmap has independently verified, endorsed, confirmed, or authenticated it.

A report appearing on the Services should not be interpreted as confirmation by Helpmap, a government authority, emergency responder, or any other organization unless the Services expressly state otherwise.

Likewise, the absence of a report does not mean that a hazard, emergency, or dangerous condition does not exist.

6. Official Information Takes Precedence


Helpmap is intended to complement and help users corroborate information from other sources.

Official evacuation orders, emergency alerts, road closures, public-health instructions, weather warnings, and other directions issued by competent public authorities should always take precedence over information appearing through Helpmap.

Before making a decision concerning personal safety, evacuation, medical treatment, fire conditions, transportation, shelter, or another potentially dangerous situation, you should consult appropriate authoritative sources whenever reasonably possible.

7. Assumption of Risk


Emergencies and hazardous environmental conditions are inherently uncertain and dangerous.

By using the Services, you acknowledge that:

  • conditions can change rapidly;

  • digital communications can fail or be delayed;

  • maps and geolocation systems can contain errors;

  • community reports can be incorrect;

  • public data can be delayed or revised;

  • photographs and descriptions may not accurately represent current conditions;

  • Helpmap cannot observe or verify all conditions on the ground; and,

  • reliance on any single source of emergency information can involve risk.

YOU ARE RESPONSIBLE FOR YOUR OWN DECISIONS AND ACTIONS BASED ON THE CIRCUMSTANCES AVAILABLE TO YOU.

To the maximum extent permitted by applicable law, you assume the risks associated with using, not using, relying upon, or acting upon information made available through the Services.

8. Community Reports


When submitting a report, you should provide information that you reasonably believe to be accurate at the time of submission.

You should report the location of the incident or condition, not your home address or personal location unless that location is itself relevant to the incident.

You agree not to knowingly submit information that is:

  • false;

  • fabricated;

  • intentionally misleading;

  • fraudulent;

  • malicious;

  • unlawfully threatening;

  • defamatory;

  • unlawfully discriminatory;

  • invasive of another person's privacy;

  • intended to interfere with emergency operations; or

  • otherwise unlawful.

You understand that conditions may change after your report is submitted and that a report may therefore become inaccurate even if it was accurate when submitted.

Helpmap may display an expiration time, timestamp, status, warning, or other contextual information concerning a report, but such features do not guarantee its continuing accuracy.

9. Personal Information & Privacy


The core Helpmap reporting system is designed around data minimization.

You are not required to provide your name, email address, telephone number, home address, or other personally identifying information to submit a report through the core web reporting interface.

Helpmap is designed to keep unnecessary personal identifiers separate from the public incident-report database.

However, limited technical information may be processed for purposes including:

  • operating the Services;

  • cybersecurity;

  • fraud prevention;

  • spam prevention;

  • abuse prevention;

  • diagnostics;

  • system reliability; and,

  • compliance with applicable law.

Third-party services, including messaging platforms, hosting providers, mapping providers, analytics services, or other infrastructure providers, may process information pursuant to their own terms and privacy practices.

If you communicate with Helpmap through a contact form, email, donation system, messaging platform, or another service outside the core reporting workflow, information required for that communication may be processed separately.

Please Do Not Submit Any Unnecessary Personal Information.

You should not include unnecessary personal information about yourself or another person in a public report. In particular, do not intentionally include:

  • names;

  • telephone numbers;

  • email addresses;

  • identification numbers;

  • private medical information;

  • financial information;

  • confidential correspondence;

  • passwords or credentials;

  • other sensitive personal information; or

  • information that could unnecessarily identify a vulnerable person.

10. Photographs & Other Media


Photographs and media can contain identifying information even when the submitter does not intend to disclose it.

You should use reasonable care to avoid unnecessarily submitting images containing identifiable faces, license plates, identification documents, private correspondence, computer screens, home addresses, or similar information.

You are responsible for determining whether you have the right to submit photographs, text, or other content.

You represent that, to the best of your knowledge, your submission does not knowingly violate another person's copyright, privacy rights, publicity rights, or other legal rights.

11. Public Reports & User Content License


You understand that reports submitted to Helpmap may be publicly displayed.

By submitting text, photographs, location information, descriptions, classifications, or other content through the Services (“User Content”), you grant Helpmap a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, format, adapt for technical purposes, translate, publish, display, distribute, communicate, archive, analyze, and otherwise use that User Content in connection with:

  • operating Helpmap;

  • public emergency information;

  • community awareness;

  • emergency preparedness;

  • emergency response and recovery;

  • research;

  • public-interest analysis;

  • journalism, media, and public communication;

  • development and improvement of the Services;

  • open-data publication; and,

  • archival or historical purposes.

This license includes the right to make qualifying report data available to third parties or under an applicable open-data license.

You retain any ownership rights you otherwise hold in your original User Content.

You understand that once public information has been distributed, downloaded, cached, archived, copied, or incorporated into an open dataset by third parties, Helpmap may be unable to retrieve or delete all copies.

12. Open Source & Open Data


Certain software underlying the Services, including components of CogniCity Open Source Software, is made available under applicable open-source licenses.

Those licenses govern the relevant open-source software independently of these Terms.

The availability of source code does not grant public access to:

  • production servers;

  • administrative systems;

  • credentials;

  • passwords;

  • private repositories;

  • cloud infrastructure;

  • restricted APIs;

  • internal security systems; or,

  • protected operational information.

Likewise, open data does not mean that all Helpmap data is public. Helpmap determines which datasets are appropriate for public release, subject to applicable law, privacy obligations, technical considerations, data licenses, contractual restrictions, and operational requirements.

13. Third-Party Services & Information


The Services may interoperate with or link to third-party products or services, including messaging applications, mapping services, government information systems, data providers, social networks, and other websites.

Examples may include WhatsApp, Messenger, Telegram, government data feeds, mapping infrastructure, and other external systems.

Helpmap does not control these third parties.

Their services may experience outages, errors, delays, security incidents, policy changes, data-quality problems, or other failures.

Use of a third-party service may also be governed by that provider's own terms, privacy policy, and technical requirements.

To the maximum extent permitted by applicable law, Helpmap is not responsible for the availability, accuracy, security, content, conduct, privacy practices, or performance of third-party services.

Links or integrations do not constitute endorsement unless expressly stated.

14. Automated Systems & Artificial Intelligence


Helpmap may use automated computational techniques, including machine-learning or other automated systems, to support technical infrastructure and back-end functions such as traffic management, resource allocation, system scaling, routing, anomaly detection, security, or operational performance.

Unless expressly stated otherwise, Helpmap does not use an autonomous AI agents or large language models to independently determine:

  • whether an emergency exists;

  • whether a community report is true;

  • whether a person is safe;

  • whether a person should evacuate;

  • whether emergency assistance should be dispatched; or,

  • what action a user should take.

Automated technical processes may themselves fail, produce errors, or be unavailable and are subject to the same limitations stated elsewhere in these Terms.

15. Moderation & Removal


Helpmap may, but is not required to, review, moderate, annotate, suppress, reject, edit, expire, restrict distribution of, or remove any submission.

Helpmap may take such action for any legitimate operational reason, including if content appears:

  • false or misleading;

  • unlawful;

  • malicious;

  • dangerous;

  • abusive;

  • duplicative;

  • irrelevant;

  • technically defective;

  • privacy-invasive;

  • inconsistent with these Terms; or,

  • otherwise inappropriate for the Services.

A decision to moderate one report does not create an obligation to moderate another report.

A failure to remove information does not constitute endorsement of that information.

Helpmap does not guarantee that objectionable, inaccurate, harmful, or unlawful content will be identified or removed within any particular period.

16. Cybersecurity


Helpmap uses reasonable operational and technical measures intended to protect the Services. However, no internet-connected system can be guaranteed to be completely secure.

To the maximum extent permitted by applicable law, Helpmap does not warrant that the Services will be free from:

  • unauthorized access;

  • malware;

  • malicious activity;

  • denial-of-service attacks;

  • vulnerabilities;

  • data loss;

  • corruption;

  • interception;

  • outages; or,

  • other cybersecurity events.

If you discover a suspected vulnerability or security issue, you should report it to Helpmap at admin@helpmap.agency and should not exploit, publicly disclose, or use the vulnerability to gain unauthorized access or interfere with the Services.

17. Prohibited Conduct


You may not use the Services to:

  • knowingly submit a false emergency or hazard report;

  • impersonate another person or organization;

  • harass, threaten, stalk, or endanger another person;

  • unlawfully disclose personal or confidential information;

  • upload malicious software or code;

  • interfere with the operation or availability of the Services;

  • attempt unauthorized access to systems, accounts, databases, infrastructure, or credentials;

  • circumvent access controls or security measures;

  • conduct unauthorized penetration testing or vulnerability exploitation;

  • use automated tools to overload, disrupt, scrape, or extract information contrary to published restrictions or applicable law;

  • manipulate reports, classifications, locations, timestamps, or verification indicators;

  • interfere with legitimate emergency response;

  • violate intellectual-property rights;

  • use the Services for unlawful surveillance;

  • use the Services for any unlawful purpose; or

  • assist another person in doing any of the foregoing.

Helpmap may restrict or block access, remove content, preserve relevant evidence, or refer suspected unlawful conduct to appropriate authorities when reasonably necessary or legally required.

18. Intellectual Property


Except for open-source components, open data released under a designated license, User Content, and third-party materials, the Services and their associated software, interface designs, graphics, text, logos, trademarks, databases, and other materials are owned by or licensed to Helpmap and are protected by applicable intellectual property laws.

“Helpmap,” “Helpmap.us,” associated logos, and related branding may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without prior written permission.

Nothing in these Terms modifies rights granted separately under an applicable open source or open data license.

19. Availability, Modification, & Discontinuation


Helpmap may modify, suspend, restrict, replace, or discontinue all or part of the Services at any time.

The Services may be unavailable because of:

  • maintenance;

  • software defects;

  • infrastructure failure;

  • cloud-service interruption;

  • loss of internet connectivity;

  • telecommunications failure;

  • third-party outages;

  • cyberattack;

  • unusual traffic;

  • funding limitations;

  • natural disasters;

  • wildfires;

  • earthquakes;

  • floods;

  • severe weather;

  • public emergencies;

  • government action; or,

  • circumstances outside Helpmap's reasonable control.

Helpmap does not guarantee continuous availability, minimum uptime, geographic coverage, data continuity, or permanent operation of any feature.

20. Disclaimer of Warranties


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the maximum extent permitted by applicable law, Helpmap disclaims all warranties, including any implied warranties of:

  • merchantability;

  • fitness for a particular purpose;

  • accuracy;

  • reliability;

  • availability;

  • non-infringement;

  • quiet enjoyment;

  • data integrity;

  • security; and,

  • suitability for emergency, safety-critical, or life-safety use.

Without limiting the foregoing, Helpmap does not warrant that:

  • information is accurate, current, complete, or verified;

  • reports will be received;

  • reports will be published;

  • reports will be acted upon;

  • information will arrive without delay;

  • the map will identify every hazard;

  • an identified hazard still exists;

  • the absence of a report means an area is safe;

  • the Services will be uninterrupted;

  • defects will be corrected;

  • third-party services will function;

  • the Services will prevent harm;

  • the Services will satisfy any particular governmental or professional standard; or,

  • use of the Services will produce any specific response, preparedness, recovery, safety, or emergency-management outcome.

No statement made by Helpmap, its personnel, contractors, volunteers, partners, or representatives creates a warranty unless expressly stated as such in a written agreement signed by an authorized representative of Helpmap.

21. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELPMAP AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AFFILIATES, PARTNERS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OPPORTUNITY, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES.

To the maximum extent permitted by applicable law, this limitation applies regardless of:

  • the legal theory asserted;

  • whether liability is alleged in contract, tort, negligence, strict liability, statute, or otherwise;

  • whether Helpmap was advised that damage was possible; or,

  • whether a remedy otherwise fails of its essential purpose.

Without limiting the foregoing, Helpmap will not be liable, to the maximum extent permitted by applicable law, for losses arising from or related to:

  • reliance on a community report;

  • reliance on third-party or government data;

  • failure to receive a report;

  • failure to display a report;

  • failure to verify a report;

  • delayed information;

  • inaccurate information;

  • omitted information;

  • incorrect geolocation;

  • failure of a user to contact emergency services;

  • actions or omissions of emergency responders or public authorities;

  • decisions to evacuate or not evacuate;

  • travel or route decisions;

  • third-party services;

  • telecommunications failure;

  • cybersecurity incidents;

  • unauthorized third-party conduct;

  • platform outages;

  • moderation decisions;

  • deletion or retention of content; or,

  • conditions occurring during an emergency.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELPMAP'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) US$100; OR (B) THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO HELPMAP FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

The limitations in these Terms do not exclude or limit liability to the extent such liability cannot lawfully be excluded or limited.

22. Indemnification


To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Helpmap and its directors, officers, employees, volunteers, contractors, affiliates, partners, licensors, service providers, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable legal expenses arising out of or relating to:

  • User Content you submit;

  • your violation of these Terms;

  • your unlawful use of the Services;

  • your infringement of another person's rights;

  • your intentional submission of false or malicious information; or

  • your misuse of information obtained through the Services.

This section does not require you to indemnify any person for conduct to the extent such indemnification is prohibited by applicable law.

23. Age and Capacity


You must be at least 13 years old to independently submit information through the Services.

If you are under the age of legal majority where you live, you should use the reporting features only with the involvement or permission of a parent or legal guardian where required by applicable law.

Third-party messaging platforms may impose different or additional age requirements.

Helpmap does not knowingly solicit personal information from children through the core emergency-reporting system.

24. Suspension and Termination


Helpmap may restrict, suspend, or terminate access to all or part of the Services when reasonably necessary to:

  • protect users;

  • protect the platform;

  • respond to misuse;

  • investigate suspected unlawful conduct;

  • comply with law;

  • address technical or security problems; or

  • maintain the integrity of the Services.

Where no account exists, Helpmap may use available technical controls to prevent or limit abusive access.

Termination or suspension does not affect provisions that by their nature should survive, including provisions concerning User Content licenses, intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

25. Copyright Complaints


If you believe material available through the Services infringes a copyright you own or control, you may send written notice to: admin@helpmap.agency. Helpmap may remove or restrict access to material alleged to infringe intellectual-property rights and may take appropriate action regarding repeated infringement.

Any formal DMCA designation or procedure will be implemented in accordance with applicable U.S. law.

26. Changes to These Terms


Helpmap may update these Terms from time to time.

The current version will be posted on Helpmap.us with the applicable “Last Updated” date.

Where legally required or where a change materially alters users' rights or obligations, Helpmap may provide additional notice or obtain renewed consent.

Your continued use of the Services after an effective update constitutes acceptance only to the extent permitted by applicable law and applicable contract-formation requirements.

27. Dispute Resolution; Informal Resolution


Before initiating formal proceedings, you and Helpmap agree to attempt in good faith to resolve any dispute arising out of or relating to the Services or these Terms.

A party initiating a dispute should send written notice describing the dispute and requested resolution.

Notices to Helpmap should be sent to: admin@helpmap.agency.

The parties will have 30 days after receipt of a complete notice to attempt informal resolution before commencing arbitration or litigation, except where immediate injunctive or other emergency relief is reasonably necessary.

28. Binding Individual Arbitration


PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes eligible for small-claims court and claims seeking appropriate temporary or injunctive relief concerning unauthorized system access, misuse, or intellectual-property rights, you and Helpmap agree that disputes arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration rather than by a judge or jury, to the extent permitted by applicable law.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Arbitration will be administered under its applicable consumer arbitration rules, as modified by these Terms and applicable law.

Helpmap will pay arbitration fees to the extent required by applicable consumer-protection law and the applicable arbitration rules.

Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.

Arbitration Opt-Out

You may opt out of this arbitration agreement by providing written notice to Helpmap within 30 days after the date you first affirmatively accept these Terms.

The notice must clearly state that you are opting out of the arbitration agreement and must provide sufficient information for Helpmap reasonably to identify your acceptance of these Terms.

Opt-out notices must be sent to: admin@helpmap.agency

Opting out of arbitration will not affect the other provisions of these Terms.

29. Class & Representative Action Waiver


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND HELPMAP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise.

If applicable law prohibits enforcement of all or part of this waiver for a particular claim or form of relief, that claim or form of relief will proceed as required by applicable law, and the remainder of this section will remain effective to the maximum extent permitted.

30. Governing Law


Except to the extent federal law governs or applicable law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles.

For any dispute that is not subject to arbitration and is not eligible for small-claims court, the parties consent, to the extent legally permissible, to the jurisdiction and venue of the state and federal courts located in Los Angeles County, California.

Nothing in this section deprives a consumer of any non-waivable protection provided by applicable law.

31. Force Majeure


Helpmap will not be responsible for delay, interruption, failure, or inability to perform resulting from circumstances beyond its reasonable control, including natural disasters, wildfires, earthquakes, floods, severe weather, public emergencies, war, terrorism, civil disturbance, labor disputes, governmental action, internet outages, telecommunications failures, cloud-service failures, power failures, cyberattacks, shortages, or failure of third-party infrastructure. This provision does not limit obligations that applicable law does not permit Helpmap to limit.

32. No Waiver


A failure by Helpmap to enforce any provision of these Terms does not waive that provision or Helpmap's right to enforce it later. Any waiver must be express and authorized in writing.

33. Severability

These Terms, together with any privacy notice, applicable open-source or open-data license, and any additional terms expressly incorporated into them, constitute the agreement governing your use of the Services.

If a separate written agreement between Helpmap and an organization expressly governs that organization's use of particular Helpmap services, that agreement will control to the extent of any conflict concerning those services.

1. Purpose of the Services


Helpmap provides community-led climate readiness, emergency mapping, information sharing, and situational-awareness technology.

The Services may allow users to:

  • view community-generated reports;

  • view information supplied by public agencies and third parties;

  • submit location-based reports concerning hazards, emergencies, infrastructure conditions, or other relevant events;

  • submit descriptions, photographs, and related information;

  • share public reports;

  • compare information from multiple sources; and

  • access other tools intended to support community awareness, preparedness, response, and recovery.

Helpmap is designed to facilitate information sharing. It is not designed to replace emergency services, official warning systems, professional advice, or decisions made by competent public authorities.

2. Helpmap Is Not an Emergency Service


HELPMAP IS NOT A 911 SERVICE, EMERGENCY DISPATCH SERVICE, FIRST-RESPONDER SERVICE, GOVERNMENT WARNING SYSTEM, OR SUBSTITUTE FOR ANY OF THEM.

If you or another person is in immediate danger, call 911 or the appropriate emergency service. Submitting information to Helpmap does not constitute contacting emergency services.

Helpmap does not promise or guarantee that:

  • an emergency responder will receive a report;

  • a government agency will receive a report;

  • any person or organization will monitor a report;

  • anyone will respond to or act upon a report;

  • a report will be transmitted immediately;

  • a report will appear on the map;

  • a report will remain on the map; or

  • any action will be taken as a result of information submitted through the Services.

You remain responsible for contacting emergency services or competent authorities when circumstances require them.

3. No Duty to Monitor, Verify, Warn, Rescue, or Act


Helpmap provides information infrastructure. Unless expressly required by applicable law, Helpmap does not undertake and does not assume any duty to:

  • continuously monitor the Services;

  • review every report;

  • independently investigate any report;

  • verify whether a report is true;

  • confirm the location of an incident;

  • confirm that a hazard still exists;

  • identify inaccurate or misleading information;

  • correct information within any particular period;

  • provide warnings;

  • identify persons in danger;

  • contact emergency responders;

  • dispatch assistance;

  • prevent injury, loss, or damage;

  • advise users whether to evacuate, shelter, travel, remain in place, or undertake any other action; or

  • ensure that government agencies, responders, community organizations, or other users receive or act upon information.

No submission, publication, moderation decision, communication, omission, or other activity by Helpmap creates a special relationship, fiduciary relationship, professional relationship, rescue obligation, emergency-response obligation, or other duty beyond any duty that applicable law expressly imposes and does not permit the parties to limit.

4. Reasonable Efforts Standard; No Guarantee


Helpmap may use reasonable efforts to operate, maintain, moderate, improve, secure, and restore the Services and to address identified technical, safety, privacy, or information-quality issues.

Any such efforts are provided on a reasonable efforts, non-guaranteed basis and are subject to available personnel, funding, infrastructure, connectivity, technical capacity, third-party services, emergency conditions, and other circumstances.

Nothing in these Terms creates:

  • a service-level agreement;

  • an uptime guarantee;

  • a response-time guarantee;

  • a verification guarantee;

  • a moderation guarantee;

  • a cybersecurity guarantee;

  • a data-retention guarantee;

  • a duty to achieve a particular result; or

  • a contractual obligation to exercise “best efforts” or any heightened standard beyond reasonable efforts required by applicable law.

Helpmap may prioritize activities in its discretion, including during emergencies when demand, outages, infrastructure failures, or rapidly changing conditions may affect the Services.

5. Information May Be Incomplete, Delayed, or Wrong


Information displayed through the Services may originate from community members, public agencies, government data feeds, mapping providers, third-party platforms, automated systems, or other external sources.

Such information may be:

  • inaccurate;

  • incomplete;

  • outdated;

  • delayed;

  • duplicated;

  • incorrectly categorized;

  • incorrectly located;

  • mistranslated;

  • unavailable;

  • based on an unverified report;

  • superseded by later events; or

  • inconsistent with information from another source.

The presence of information on Helpmap does not guarantee that Helpmap has independently verified, endorsed, confirmed, or authenticated it.

A report appearing on the Services should not be interpreted as confirmation by Helpmap, a government authority, emergency responder, or any other organization unless the Services expressly state otherwise.

Likewise, the absence of a report does not mean that a hazard, emergency, or dangerous condition does not exist.

6. Official Information Takes Precedence


Helpmap is intended to complement and help users corroborate information from other sources.

Official evacuation orders, emergency alerts, road closures, public-health instructions, weather warnings, and other directions issued by competent public authorities should always take precedence over information appearing through Helpmap.

Before making a decision concerning personal safety, evacuation, medical treatment, fire conditions, transportation, shelter, or another potentially dangerous situation, you should consult appropriate authoritative sources whenever reasonably possible.

7. Assumption of Risk


Emergencies and hazardous environmental conditions are inherently uncertain and dangerous.

By using the Services, you acknowledge that:

  • conditions can change rapidly;

  • digital communications can fail or be delayed;

  • maps and geolocation systems can contain errors;

  • community reports can be incorrect;

  • public data can be delayed or revised;

  • photographs and descriptions may not accurately represent current conditions;

  • Helpmap cannot observe or verify all conditions on the ground; and,

  • reliance on any single source of emergency information can involve risk.

YOU ARE RESPONSIBLE FOR YOUR OWN DECISIONS AND ACTIONS BASED ON THE CIRCUMSTANCES AVAILABLE TO YOU.

To the maximum extent permitted by applicable law, you assume the risks associated with using, not using, relying upon, or acting upon information made available through the Services.

8. Community Reports


When submitting a report, you should provide information that you reasonably believe to be accurate at the time of submission.

You should report the location of the incident or condition, not your home address or personal location unless that location is itself relevant to the incident.

You agree not to knowingly submit information that is:

  • false;

  • fabricated;

  • intentionally misleading;

  • fraudulent;

  • malicious;

  • unlawfully threatening;

  • defamatory;

  • unlawfully discriminatory;

  • invasive of another person's privacy;

  • intended to interfere with emergency operations; or

  • otherwise unlawful.

You understand that conditions may change after your report is submitted and that a report may therefore become inaccurate even if it was accurate when submitted.

Helpmap may display an expiration time, timestamp, status, warning, or other contextual information concerning a report, but such features do not guarantee its continuing accuracy.

9. Personal Information & Privacy


The core Helpmap reporting system is designed around data minimization.

You are not required to provide your name, email address, telephone number, home address, or other personally identifying information to submit a report through the core web reporting interface.

Helpmap is designed to keep unnecessary personal identifiers separate from the public incident-report database.

However, limited technical information may be processed for purposes including:

  • operating the Services;

  • cybersecurity;

  • fraud prevention;

  • spam prevention;

  • abuse prevention;

  • diagnostics;

  • system reliability; and,

  • compliance with applicable law.

Third-party services, including messaging platforms, hosting providers, mapping providers, analytics services, or other infrastructure providers, may process information pursuant to their own terms and privacy practices.

If you communicate with Helpmap through a contact form, email, donation system, messaging platform, or another service outside the core reporting workflow, information required for that communication may be processed separately.

Please Do Not Submit Any Unnecessary Personal Information.

You should not include unnecessary personal information about yourself or another person in a public report. In particular, do not intentionally include:

  • names;

You should use reasonable care to avoid unnecessarily submitting images containing identifiable faces, license plates, identification documents, private correspondence, computer screens, home addresses, or similar information.

You are responsible for determining whether you have the right to submit photographs, text, or other content.

You represent that, to the best of your knowledge, your submission does not knowingly violate another person's copyright, privacy rights, publicity rights, or other legal rights.

11. Public Reports & User Content License


You understand that reports submitted to Helpmap may be publicly displayed.

By submitting text, photographs, location information, descriptions, classifications, or other content through the Services (“User Content”), you grant Helpmap a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, format, adapt for technical purposes, translate, publish, display, distribute, communicate, archive, analyze, and otherwise use that User Content in connection with:

  • operating Helpmap;

  • public emergency information;

  • community awareness;

  • emergency preparedness;

  • emergency response and recovery;

  • research;

  • public-interest analysis;

  • journalism, media, and public communication;

  • development and improvement of the Services;

  • open-data publication; and,

  • archival or historical purposes.

This license includes the right to make qualifying report data available to third parties or under an applicable open-data license.

You retain any ownership rights you otherwise hold in your original User Content.

You understand that once public information has been distributed, downloaded, cached, archived, copied, or incorporated into an open dataset by third parties, Helpmap may be unable to retrieve or delete all copies.

12. Open Source & Open Data


Certain software underlying the Services, including components of CogniCity Open Source Software, is made available under applicable open-source licenses.

Those licenses govern the relevant open-source software independently of these Terms.

The availability of source code does not grant public access to:

  • production servers;

  • administrative systems;

  • credentials;

  • passwords;

  • private repositories;

  • cloud infrastructure;

  • restricted APIs;

  • internal security systems; or,

  • protected operational information.

Likewise, open data does not mean that all Helpmap data is public. Helpmap determines which datasets are appropriate for public release, subject to applicable law, privacy obligations, technical considerations, data licenses, contractual restrictions, and operational requirements.

13. Third-Party Services & Information


The Services may interoperate with or link to third-party products or services, including messaging applications, mapping services, government information systems, data providers, social networks, and other websites.

Examples may include WhatsApp, Messenger, Telegram, government data feeds, mapping infrastructure, and other external systems.

Helpmap does not control these third parties.

Their services may experience outages, errors, delays, security incidents, policy changes, data-quality problems, or other failures.

Use of a third-party service may also be governed by that provider's own terms, privacy policy, and technical requirements.

To the maximum extent permitted by applicable law, Helpmap is not responsible for the availability, accuracy, security, content, conduct, privacy practices, or performance of third-party services.

Links or integrations do not constitute endorsement unless expressly stated.

14. Automated Systems & Artificial Intelligence


Helpmap may use automated computational techniques, including machine-learning or other automated systems, to support technical infrastructure and back-end functions such as traffic management, resource allocation, system scaling, routing, anomaly detection, security, or operational performance.

Unless expressly stated otherwise, Helpmap does not use an autonomous AI agents or large language models to independently determine:

  • whether an emergency exists;

  • whether a community report is true;

  • whether a person is safe;

  • whether a person should evacuate;

  • whether emergency assistance should be dispatched; or,

  • what action a user should take.

Automated technical processes may themselves fail, produce errors, or be unavailable and are subject to the same limitations stated elsewhere in these Terms.

15. Moderation & Removal


Helpmap may, but is not required to, review, moderate, annotate, suppress, reject, edit, expire, restrict distribution of, or remove any submission.

Helpmap may take such action for any legitimate operational reason, including if content appears:

  • false or misleading;

  • unlawful;

  • malicious;

  • dangerous;

  • abusive;

  • duplicative;

  • irrelevant;

  • technically defective;

  • privacy-invasive;

  • inconsistent with these Terms; or,

  • otherwise inappropriate for the Services.

A decision to moderate one report does not create an obligation to moderate another report.

A failure to remove information does not constitute endorsement of that information.

Helpmap does not guarantee that objectionable, inaccurate, harmful, or unlawful content will be identified or removed within any particular period.

16. Cybersecurity


Helpmap uses reasonable operational and technical measures intended to protect the Services. However, no internet-connected system can be guaranteed to be completely secure.

To the maximum extent permitted by applicable law, Helpmap does not warrant that the Services will be free from:

  • unauthorized access;

  • malware;

  • malicious activity;

  • denial-of-service attacks;

  • vulnerabilities;

  • data loss;

  • corruption;

  • interception;

  • outages; or,

  • other cybersecurity events.

If you discover a suspected vulnerability or security issue, you should report it to Helpmap at admin@helpmap.agency and should not exploit, publicly disclose, or use the vulnerability to gain unauthorized access or interfere with the Services.

17. Prohibited Conduct


You may not use the Services to:

  • knowingly submit a false emergency or hazard report;

  • impersonate another person or organization;

  • harass, threaten, stalk, or endanger another person;

  • unlawfully disclose personal or confidential information;

  • upload malicious software or code;

  • interfere with the operation or availability of the Services;

  • attempt unauthorized access to systems, accounts, databases, infrastructure, or credentials;

  • circumvent access controls or security measures;

  • conduct unauthorized penetration testing or vulnerability exploitation;

  • use automated tools to overload, disrupt, scrape, or extract information contrary to published restrictions or applicable law;

  • manipulate reports, classifications, locations, timestamps, or verification indicators;

  • interfere with legitimate emergency response;

  • violate intellectual-property rights;

  • use the Services for unlawful surveillance;

  • use the Services for any unlawful purpose; or

  • assist another person in doing any of the foregoing.

Helpmap may restrict or block access, remove content, preserve relevant evidence, or refer suspected unlawful conduct to appropriate authorities when reasonably necessary or legally required.

18. Intellectual Property


Except for open-source components, open data released under a designated license, User Content, and third-party materials, the Services and their associated software, interface designs, graphics, text, logos, trademarks, databases, and other materials are owned by or licensed to Helpmap and are protected by applicable intellectual property laws.

“Helpmap,” “Helpmap.us,” associated logos, and related branding may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without prior written permission.

Nothing in these Terms modifies rights granted separately under an applicable open source or open data license.

19. Availability, Modification, & Discontinuation


Helpmap may modify, suspend, restrict, replace, or discontinue all or part of the Services at any time.

The Services may be unavailable because of:

  • maintenance;

  • software defects;

  • infrastructure failure;

  • cloud-service interruption;

  • loss of internet connectivity;

  • telecommunications failure;

  • third-party outages;

  • cyberattack;

  • unusual traffic;

  • funding limitations;

  • natural disasters;

  • wildfires;

  • earthquakes;

  • floods;

  • severe weather;

  • public emergencies;

  • government action; or,

  • circumstances outside Helpmap's reasonable control.

Helpmap does not guarantee continuous availability, minimum uptime, geographic coverage, data continuity, or permanent operation of any feature.

20. Disclaimer of Warranties


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the maximum extent permitted by applicable law, Helpmap disclaims all warranties, including any implied warranties of:

  • merchantability;

  • fitness for a particular purpose;

  • accuracy;

  • reliability;

  • availability;

  • non-infringement;

  • quiet enjoyment;

  • data integrity;

  • security; and,

  • suitability for emergency, safety-critical, or life-safety use.

Without limiting the foregoing, Helpmap does not warrant that:

  • information is accurate, current, complete, or verified;

  • reports will be received;

  • reports will be published;

  • reports will be acted upon;

  • information will arrive without delay;

  • the map will identify every hazard;

  • an identified hazard still exists;

  • the absence of a report means an area is safe;

  • the Services will be uninterrupted;

  • defects will be corrected;

  • third-party services will function;

  • the Services will prevent harm;

  • the Services will satisfy any particular governmental or professional standard; or,

  • use of the Services will produce any specific response, preparedness, recovery, safety, or emergency-management outcome.

No statement made by Helpmap, its personnel, contractors, volunteers, partners, or representatives creates a warranty unless expressly stated as such in a written agreement signed by an authorized representative of Helpmap.

21. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELPMAP AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AFFILIATES, PARTNERS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OPPORTUNITY, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES.

To the maximum extent permitted by applicable law, this limitation applies regardless of:

  • the legal theory asserted;

  • reliance on a community report;

  • reliance on third-party or government data;

  • failure to receive a report;

  • failure to display a report;

  • failure to verify a report;

  • delayed information;

  • inaccurate information;

  • omitted information;

  • incorrect geolocation;

  • failure of a user to contact emergency services;

  • actions or omissions of emergency responders or public authorities;

  • decisions to evacuate or not evacuate;

  • travel or route decisions;

  • third-party services;

  • telecommunications failure;

  • cybersecurity incidents;

  • unauthorized third-party conduct;

  • platform outages;

  • moderation decisions;

  • deletion or retention of content; or,

  • conditions occurring during an emergency.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELPMAP'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) US$100; OR (B) THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO HELPMAP FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

22. Indemnification


To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Helpmap and its directors, officers, employees, volunteers, contractors, affiliates, partners, licensors, service providers, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable legal expenses arising out of or relating to:

  • User Content you submit;

  • your violation of these Terms;

  • your unlawful use of the Services;

  • your infringement of another person's rights;

  • your intentional submission of false or malicious information; or

  • your misuse of information obtained through the Services.

This section does not require you to indemnify any person for conduct to the extent such indemnification is prohibited by applicable law.

23. Age and Capacity


You must be at least 13 years old to independently submit information through the Services.

If you are under the age of legal majority where you live, you should use the reporting features only with the involvement or permission of a parent or legal guardian where required by applicable law.

Third-party messaging platforms may impose different or additional age requirements.

Helpmap does not knowingly solicit personal information from children through the core emergency-reporting system.

24. Suspension and Termination


Helpmap may restrict, suspend, or terminate access to all or part of the Services when reasonably necessary to:

  • protect users;

  • protect the platform;

  • respond to misuse;

  • investigate suspected unlawful conduct;

  • comply with law;

  • address technical or security problems; or

  • maintain the integrity of the Services.

Where no account exists, Helpmap may use available technical controls to prevent or limit abusive access.

Termination or suspension does not affect provisions that by their nature should survive, including provisions concerning User Content licenses, intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

25. Copyright Complaints


If you believe material available through the Services infringes a copyright you own or control, you may send written notice to: admin@helpmap.agency. Helpmap may remove or restrict access to material alleged to infringe intellectual-property rights and may take appropriate action regarding repeated infringement.

Any formal DMCA designation or procedure will be implemented in accordance with applicable U.S. law.

26. Changes to These Terms


Helpmap may update these Terms from time to time.

The current version will be posted on Helpmap.us with the applicable “Last Updated” date.

Where legally required or where a change materially alters users' rights or obligations, Helpmap may provide additional notice or obtain renewed consent.

Your continued use of the Services after an effective update constitutes acceptance only to the extent permitted by applicable law and applicable contract-formation requirements.

27. Dispute Resolution; Informal Resolution


Before initiating formal proceedings, you and Helpmap agree to attempt in good faith to resolve any dispute arising out of or relating to the Services or these Terms.

A party initiating a dispute should send written notice describing the dispute and requested resolution.

The parties will have 30 days after receipt of a complete notice to attempt informal resolution before commencing arbitration or litigation, except where immediate injunctive or other emergency relief is reasonably necessary.

28. Binding Individual Arbitration

Except for disputes eligible for small-claims court and claims seeking appropriate temporary or injunctive relief concerning unauthorized system access, misuse, or intellectual-property rights, you and Helpmap agree that disputes arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration rather than by a judge or jury, to the extent permitted by applicable law.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Arbitration will be administered under its applicable consumer arbitration rules, as modified by these Terms and applicable law.

Helpmap will pay arbitration fees to the extent required by applicable consumer-protection law and the applicable arbitration rules.

Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.

Arbitration Opt-Out

29. Class & Representative Action Waiver


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND HELPMAP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise.

If applicable law prohibits enforcement of all or part of this waiver for a particular claim or form of relief, that claim or form of relief will proceed as required by applicable law, and the remainder of this section will remain effective to the maximum extent permitted.

30. Governing Law


Except to the extent federal law governs or applicable law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles.

For any dispute that is not subject to arbitration and is not eligible for small-claims court, the parties consent, to the extent legally permissible, to the jurisdiction and venue of the state and federal courts located in Los Angeles County, California.

Nothing in this section deprives a consumer of any non-waivable protection provided by applicable law.

31. Force Majeure


Helpmap will not be responsible for delay, interruption, failure, or inability to perform resulting from circumstances beyond its reasonable control, including natural disasters, wildfires, earthquakes, floods, severe weather, public emergencies, war, terrorism, civil disturbance, labor disputes, governmental action, internet outages, telecommunications failures, cloud-service failures, power failures, cyberattacks, shortages, or failure of third-party infrastructure. This provision does not limit obligations that applicable law does not permit Helpmap to limit.

32. No Waiver


A failure by Helpmap to enforce any provision of these Terms does not waive that provision or Helpmap's right to enforce it later. Any waiver must be express and authorized in writing.

33. Severability


If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will continue in effect, except where applicable law requires a different result.

34. Assignment


You may not assign or transfer your rights or obligations under these Terms without Helpmap's prior written consent. Helpmap may assign or transfer these Terms in connection with a reorganization, merger, transfer of operations, successor organization, or other lawful organizational transaction, subject to applicable law.

35. Entire Agreement


These Terms, together with any privacy notice, applicable open-source or open-data license, and any additional terms expressly incorporated into them, constitute the agreement governing your use of the Services.

If a separate written agreement between Helpmap and an organization expressly governs that organization's use of particular Helpmap services, that agreement will control to the extent of any conflict concerning those services.

The Helpmap.us Frequently Asked Questions are provided as a plain-language explanation of the Services and do not modify these Terms. If the FAQ and these Terms conflict, these Terms control.
